Kiwexa OÜ is an Estonian company operating a digital real estate marketplace. Kiwexa provides technology, marketing, listing, and lead generation services only.

3. Eligibility

4. User Accounts

Users are responsible for:

6. Property Listings

Users submitting listings confirm that:

• They are authorised to market the property.
• Information provided is accurate.
• Images and content belong to them or are used with permission.

False, misleading, or fraudulent listings are prohibited.

7. Payments

Payments made to Kiwexa relate solely to services provided by Kiwexa, including subscriptions, advertising, premium listings, and marketplace services. Kiwexa does not receive, hold, manage, or distribute funds relating to property purchases, rental income, investments, or transactions between marketplace participants.

8. Marketplace Transactions

Kiwexa acts solely as an online marketplace. All negotiations, contracts, due diligence, payments, settlements, rental agreements, and property management agreements are conducted directly between the relevant parties. Kiwexa is not a party to those agreements.

9. No Financial Services

Kiwexa does not provide:

• Financial advice
• Escrow services
• Custody services
• Money transmission
• Payment processing on behalf of third parties
• Securities trading

Users remain solely responsible for their own investment decisions.

10. Fees

Certain services require payment. Applicable fees are displayed before purchase. Fees may include:

• Subscription fees
• Listing fees
• Premium promotion fees
• Marketing packages
• Lead generation services

11. Refund Policy

Refund requests are considered in accordance with Kiwexa's Refund Policy. Digital services already delivered or activated may not be refundable unless required by applicable law.

12. Intellectual Property

All platform content including logos, software, design, graphics, branding, and databases remain the property of Kiwexa unless otherwise stated.

13. Prohibited Activities

Users may not:

• Upload fraudulent listings.
• Violate applicable laws.
• Infringe intellectual property rights.
• Upload malware.
• Attempt unauthorized access.
• Misrepresent property ownership.
• Use the platform for illegal purposes.

14. Limitation of Liability

Kiwexa provides the platform on an "as available" basis. To the maximum extent permitted by law, Kiwexa shall not be liable for:

• Property transactions.
• Investment decisions.
• Loss of profits.
• Business interruption.
• Errors in listings provided by users.
• Actions of buyers, sellers, brokers, or third parties.

15. Indemnification

Users agree to indemnify and hold harmless Kiwexa OÜ, its directors, officers, employees, and affiliates against claims arising from their use of the platform or violation of these Terms.

16. Privacy

Use of the platform is also governed by our Privacy Policy.

17. Suspension and Termination

Kiwexa may suspend or terminate user accounts without notice where necessary to protect the platform, comply with legal obligations, prevent fraud, or enforce these Terms.

18. Changes to the Terms

Kiwexa may update these Terms from time to time. Updated versions will be published on the website. Continued use of the platform constitutes acceptance of the revised Terms.

19. Governing Law
